Exam: Fair Labor Standards Act (FLSA): The Basics

FLSA requires employers to provided employees reasonable vacation, sick leave and paid holidays.

Elected officials are entitled to a guaranteed minimum hourly wage under the FLSA.

State and local governments may require employers to give employees more benefits than does the FLSA.

The FLSA requires public employers to offer non-exempt employees compensatory time as an alternative to paid overtime.

Actual duties rather than job titles are used to help determine if a person is exempt from FLSA overtime requirements.

Time spent off duty by a canine handler is not considered work hours for FLSA purposes.

To be an exempt executive, administrative, professional or executive employee the employee must be guaranteed a certain minimum wage set by department of Labor regulations.

For non-exempt employees compensatory time is earned at time and a half.

In law enforcement any person with the rank of sergeant or higher will always be an exempt executive employee for overtime purposes.

FLSA allows employees to do shift exchanges as long as they are voluntary and for the mutual benefit of the employees involved without duress or coercion by the employer.
